1. Acceptance of these terms
By using the SimpleXD website or requesting SimpleXD services, you agree to these Terms of Service. If you act on behalf of a company, family, estate, trust, investment group or other organisation, you confirm that you have authority to do so.
2. Website information
Website content is provided for general information about SimpleXD services. It is not legal, financial, tax, engineering, architectural or investment advice and is not a guarantee of project outcome, property value, title status, construction cost or regulatory approval.
3. Proposals and service agreements
Project-specific deliverables, fees, timelines, reporting frequency, support, payment terms, ownership, confidentiality and data processing are governed by the applicable proposal, quotation, statement of work, invoice, service agreement or written instructions accepted by SimpleXD.
4. Client responsibilities
- Provide accurate, complete and timely information.
- Confirm you have permission to share property documents, photos, access details and personal information with SimpleXD.
- Arrange lawful site access and disclose known risks, disputes, defects or restrictions.
- Review reports, recommendations and deliverables before making decisions.
- Use appropriate professionals for legal, valuation, tax, surveying, engineering or regulated advice where needed.
5. Field reports, inspections and limitations
SimpleXD reports are based on information available at the time of inspection, monitoring or review. Hidden defects, title issues, third-party fraud, market changes, government actions, weather, contractor performance, access restrictions and incomplete information may affect outcomes. Unless expressly agreed, inspections are visual and non-invasive.
6. AI outputs and human review
SimpleXD may use automation or AI-supported tools to help organise information, draft summaries or improve service workflows. AI-supported outputs can contain errors or omissions and must be reviewed by qualified humans before use in legal, financial, regulated, safety-critical or high-impact decisions.
7. Acceptable use
You must not use the website or services to submit unlawful content, process data without permission, misrepresent ownership or authority, harass others, distribute malware, scrape systems, attempt unauthorised access, interfere with security, or request harmful, fraudulent or discriminatory AI or automation use.
8. Intellectual property
SimpleXD owns its website, brand, templates, methods, reusable tools, software components and pre-existing materials. You retain ownership of materials you provide. Unless a written agreement says otherwise, deliverables are licensed to you for the agreed project purpose after full payment.
9. Confidentiality and data protection
We take reasonable steps to protect confidential client information and personal data. You agree not to share other people’s personal information with SimpleXD unless you have a lawful basis or permission to do so.
10. Third-party services and availability
SimpleXD may rely on hosting, communications, maps, analytics, storage, payment, inspection, contractor, professional adviser or other third-party services. We are not responsible for outages, delays, errors or acts of third parties outside our reasonable control.
11. Fees, payments and cancellation
Fees and payment schedules are stated in the applicable quotation, invoice or written agreement. Work may be paused for overdue payments. Cancellation, refunds or rescheduling depend on the accepted proposal and the stage of work already performed.
12. Disclaimers and liability
To the fullest extent allowed by law, SimpleXD provides the website and general information on an “as is” basis. We are not liable for indirect, incidental, consequential, special or punitive losses, lost profits, lost opportunities or decisions made without appropriate professional review. Any liability for paid services is limited to the amount paid for the specific service giving rise to the claim, unless the law requires otherwise.
13. Indemnity
You agree to indemnify SimpleXD, Evo Technologies LTD, team members and partners from claims, losses or costs arising from your misuse of the website or services, inaccurate information, unauthorised data sharing, unlawful instructions or breach of these terms.
14. Governing law
These terms are governed by the laws applicable to Evo Technologies LTD and the SimpleXD operating location, unless a separate written agreement states otherwise.
